A deception will be deliberate when the defendant knows that what he represents as true is untrue. This is predominantly a subjective test, matching the general approach to establishing intentional behaviour. The test of recklessness is also predominantly subjective to show that the defendant is aware that what is represented may or may not be true, excluding the extended meaning of recklessness in R v Caldwell [1982] AC 341.

Nice way for me to introduce myself guys.

    Great forum btw.
LOL, thanks for clearing that one up.

Sometimes it feels as though the net has a different set of rules but I guess deception is just as easily proven online as it is off... unless... purely hypothetical and I am not suggesting I would do this for one moment but what if some (anonymous) person pretended to be HSBC and added a simple link and some text to a free add directory without HSBC's permission, how would one know that it wasn't someone adding links on behalf of HSBC?

This actually brings me to something I have been reading on many directories, some send you an email for you to confirm that you want yourwebsite.com to be listed in their directory or not, this (I should imagine?) is to try and eliminate haters from listing someone they have a grievance against in a dodgy category like porn or alike, the obvious flaw is that you can give any email address (only a couple state that you cannot give hotmail or that it should be an address linked to the domain your are sub, itting), I made a non traceable email address in hotmail so that all the spam I will receive (it has started already) doesn't effect my normal email address.

Sorry if this is totally off topic, please move to another thread if it is?
